$1,000,000 Intel Make Something Unreal Contest


ELIGIBILITY


The $1 Million Intel Make Something Unreal Contest (the "Contest") is open to individuals (or "Teams" comprised of individuals, as listed below) who are at least 18 years old and who are lawful residents of the 50 U.S. states, the District of Columbia or Canada (excluding Quebec) and can speak, read and understand English. The Contest is also open to English-speaking persons, at least 18 years old (or the age of majority in jurisdictions where the age of majority is over 18 years and where such Contest is legal), and resident in a non-U.S.-embargoed country ("Contestant"). An accredited university, college, community college, or high school, located in the 50 U.S. states, the District of Columbia, Canada (excluding Quebec), or any non-U.S.-embargoed country, that awards academic degrees, may also be a Contestant, subject to certain limitations, set forth in the section entitled "Eligibility" below. See Overview Page located at www.makesomethingunreal.com/overview.aspx for more details. Contestants must have legal access to the internet and means to create and upload a software game modification(s) such that Contest judges and the public can download your modification(s). The Contest is void wherever else restricted or prohibited by law. The Contest may only be entered from and in eligible jurisdictions. ALL ENTRIES MUST BE SUBMITTED DURING THE CONTEST PERIOD. Entries submitted before or after Contest period will not be considered or judged. Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules. All federal, state, and local laws and regulations apply.

Contestants may be comprised of the following:

  1. Individuals: A natural person who is solely responsible for the creation of the contest entry.
  2. Teams: Team Submissions are permitted. Teams must designate one person ("Team Representative") to represent the team in entering Team Submissions. Any prize awarded to a Team, shall be presented to the Team Representative.
  3. Students/Faculty: Student/faculty Submissions are permitted. Student/Faculty Contestants must designate a "Team Representative" to represent the team for Student/Faculty Submissions. Student/Faculty Contestants must come from enrolled student or faculty member teams of an accredited university, college, community college, or high school ("School"). Entries submitted on behalf of a School shall have authorization from that school to do so, including the school's willingness to accept a prize (should it be selected a prize winner), and its agreement to abide by these official rules.

SPONSOR


The Contest is sponsored by Epic Games, Inc., 620 Crossroads Blvd., Cary, NC 27518 and Intel Corporation, 2200 Mission College Blvd., Santa Clara, CA 95052 (collectively, "Sponsor"). Employees of Sponsor, its parents and subsidiaries, advertising and promotion agencies and all other entities participating in the design, promotion, marketing, advertising, administration or fulfillment of this Contest and their immediate families and persons living in their same household are ineligible to participate in this Contest.

CONTEST PERIOD


The Contest begins at 12:00:01 a.m. U.S. Eastern Daylight Time ("US EDT") on May 29, 2008 and ends at 11:59:59 p.m. U.S. Eastern Standard Time ("US EST") on August 31, 2009 ("Contest Period").

CONTEST DESCRIPTION


Contestants will create one or more modifications ("mods") of their choosing, and according to defined categories, for the PC version of Unreal Tournament 3. A complete list of category descriptions (and links to mod-making resources) is found on our Categories page, www.makesomethingunreal.com/categories.aspx. The Contest consists of four (4) Evaluation Phases and one (1) final round. The Grand Prize Winner will be chosen in the final round. You may enter your mod ("Submission") in any Evaluation Phase that is open for that category, subject to each Evaluation Phase's submission deadline ("Phase Submission Deadline").

HOW TO ENTER


To enter, review the mod-making resources links located on our Categories page, www.makesomethingunreal.com/categories.aspx, choose your category, and make your best mod. Once you have created your Submission according to the Submission Guidelines in these official rules, access the registration form at login.makesomethingunreal.com/login.aspx. You will be required to register with FilePlanet by providing your name, address, date of birth, email address, telephone number, and a password. If you already have a FilePlanet username and password, you may log into the web site using your existing ID. Next, access the mod submission form at www.makesomethingunreal.com/SubmitFile.aspx. You will be required to use the browse button to select the appropriate file for upload, provide a descriptive title for your Submission, the name of the Contestant or Team, mod description, as well as the name of a comparable game. Here, you may also provide information such as the changelog, special instructions, and a URL relevant to your Team or Submission. After you have populated the submission form, click Submit, and wait until the confirmation page is displayed. You will be pointed to the direct, public link for your Submission.

SUBMISSION GUIDELINES


You may enter as many times as you wish in any Category described at www.makesomethingunreal.com/categories.aspx. Once uploaded, you may resubmit your Submission up to three (3) times prior to the close of an evaluation Phase. The mod submitted prior to and closest in time to the close of the Evaluation Phase Submission Deadline will be considered for that particular Evaluation Phase. All Submissions must be the Contestant's original creation, executed solely by the Contestant, and any credits must be limited to the Contestant's name(s) only. The content of the Submission must not be subject to the rights of any third parties, other than Sponsors and/or its licensors. The Submission may not be offensive or otherwise unsuitable for use, as determined in Sponsors sole discretion. Contestants must comply with the $1 Million Intel Make Something Unreal Contest Terms of Use and Privacy Policy (www.makesomethingunreal.com/tos.aspx), Unreal Tournament 3 End User License Agreement ("End User Agreement") (www.unrealtournament3.com/eula/eula_us.php), and all Unreal Tournament 3 rules, regulations, and policies as well as all rules, regulations, policies of the www.makesomethingunreal.com web site. Any submission of robotic, automatic, or programmed entries, or any entries submitted through other unapproved methods are void. Your Submission(s) must be easily installable using the installation methods specified at udn.epicgames.com/Three/UT3Mods.html. Sponsor shall not be responsible for reviewing Submissions that are unworkable for any reason.

All Submissions must be available for free public download at the time of submission and playable with the retail version of Unreal Tournament 3 patched to the latest officially released update.

Submissions that do not comply with the End User Agreement and these Official Rules will be disqualified.

Submissions may not promote third party products or services, or incorporate third party intellectual property, including, but not limited to copyright protected software, images, characters, logos, names and trademarks.

SUBMISSION DEADLINES


The Phase Submission Deadlines are set forth in the table below:

EVALUATION PHASES


During each Evaluation Phase, all Submissions will first be screened for initial compliance with minimum standards for playability. Those Submissions found to be in compliance with Sponsor's minimum standards will then be reviewed and judged by a panel of qualified judges selected by Sponsor. Submissions receiving particularly high scores will be highlighted on the $1 Million Intel Make Something Unreal Contest website (located at www.makesomethingunreal.com) for public view. Each Evaluation Phase is an independent event. Receiving a high score, an honorable mention or praise in any of the first three Phases does not mean you will advance to another stage and is not a prediction or indication of your success in subsequent Phases. Following each Evaluation Phase, Sponsor may provide written feedback regarding an entered mod. Feedback will be posted on the contest website at www.makesomethingunreal.com and will be publicly viewable. Not all Contestants or Submissions will receive written feedback.

In order to compete with other Contestants for the Grand Prize, your Submission must be entered in Evaluation Phases 1, 2, 3, or 4. Evaluation Phases 1, 2, and 3 are designed to give Contestants the options of peer review and feedback on their Submission and do not have inherent value in determining Finalists for Grand Prize. You may enter only Phase 4 if you choose. All Submissions must comply with the applicable Unreal Tournament 3 End User License Agreement posted at www.unrealtournament3.com/eula/eula_us.php.

Submissions will be judged according to the judging criteria listed below. Those Submissions that receive the highest score will be deemed Finalists and are eligible to move to the final round of judging ("Final Round"). Up to 12 Submissions will be selected as finalists ("Finalists"). Finalists will be contacted by Sponsor or a representative of Sponsor and will have up to 72 hours to respond via email and confirm their interest in moving to the Final Round. Contestants whose Submissions will be allowed to make modification to their Submission up to and including November 13, 2009 11:59:59 p.m. U.S. EST, according to Sponsor's internal clock.

By participating in the Contest, you are granting Sponsor: (1) The right to place links to your mod(s) download/viewing URL on their web sites and on the contest web site. (2) The right to host your mod on their web site(s) and on the contest web site, as well as provide copies of your entered mod(s) for use on magazine cover discs, Unreal fan sites, download sites, and other web sites of Sponsor's choosing.

JUDGING CRITERIA


For Evaluation Phases 1 through 4, Submissions will be evaluated on a preliminary basis only by qualified judges and evaluators.

At the end of Phase 4, Submissions will be judged by qualified judges and evaluators using the judging criteria set forth in these Official Rules. All judges' decisions are final and binding in all respects. . All Entries will be judged on a 1-100 point scale, using the following criteria: Creativity, Visuals, Innovation, Fun, Quality, Polish and Gameplay.

At Sponsor's discretion, Submissions may be judged in multiple categories. In the unlikely event of a tie for any portion of the Contest, the judging panel shall break that tie by rescoring the tying entries. In the event that Submissions in any Category do not receive a score of at least 70 points, no Finalist will be selected. In the event that no Entry receives a combined score of at least 70 points, no prize will be awarded. Those Submissions that receive the highest scores will move on to the final round. On or about October 1, 2009, Sponsor will announce the Finalists who will complete for the Grand Prize.

FINAL JUDGING ROUND


For each Category, up to 12 Finalists may be selected at the end of Phase 4 to compete for the Grand Prize in the Final Round. The number of finalists per Category is not predetermined. Finalists shall be notified using the information contained in the entry form and the Finalist Submissions will be featured on Sponsor's website, located at www.makesomethingunreal.com.

Finalists will have until November 13, 2009 11:59:59 p.m. U.S. EST to make updates, improvements and modifications they choose to their existing Submission. On or about November 20, 2009, a panel of qualified judges will review and score the Finalist Submissions using the criteria listed in these Official Rules. The Submission receiving the highest overall score across categories will be selected as Grand Prize winner ("Selected Contestant"). The Selected Contestant's Submission will be highlighted on the official contest web site.

Selected Contestant will be notified on or about December 1, 2009.

PRIZES. One Grand Prize


The Grand Prize Selected Entrant will receive a non-commercial, Unreal Engine 3 educational development license. No part of the Grand Prize is redeemable for cash. No substitutions, except by Sponsor. If within 3 years of selection of the Submission as the Selected Contestant, the Submission is made commercially viable, the Selected Contestant may, at Selected Contestant's option, exchange the educational development license for a single game commercial Unreal Engine 3 license. Selected Contestant cannot assign or transfer the prize to another person. No prize substitution is allowed except at the discretion of Sponsor. If prize cannot be awarded due to circumstances beyond the control of Sponsor, a substitute prize of equal or greater retail value may be awarded. Prizes will be awarded, subject to the limitations stated in these official rules. Any costs or fees not specifically listed herein are the responsibility of Selected Contestant. Taxes, if any, are the sole responsibility of Selected Contestant, and entrants may be issued an IRS Form 1099 for the ARV of any awarded prize. This Contest is void where prohibited or restricted by law, and subject to applicable federal, state provincial and local laws.

REQUIREMENTS OF WINNER/PUBLICITY


Selected Contestant(s) (whether individual, part of a Team, or from a School) must provide Sponsors a Taxpayer Identification Number ("TIN") prior to the awarding of any prize. In the event of a dispute as to authorship of a Submission, Sponsors reserve the right to disqualify any Submission, Contestant, or winner; or to determine that the actual Contestant shall be the natural person who is listed as the authorized user for the contact email address. Sponsor's eligibility decisions are final. Selected Contestants will be required to sign license agreements in order to receive prize as listed. In addition, Selected Contestants will be required to sign and return releases of liability, declarations of eligibility, and where lawful, publicity consent agreements, within five (5) days of acknowledged notification. By agreeing to become the Grand Prize winner and/or accepting and/or using The Grand Prize, winner agrees to the use of his or her name, voice and/or likeness, and entry, for the purpose of advertising, trade, or promotion without further compensation, unless prohibited by law. If a selected potential winner cannot be contacted, is ineligible (under these rules or due to a failure to comply with any of the other applicable policies, licenses, rules, and terms of service, fails to claim a prize, or fails to timely return the completed and executed releases/agreements as required), prize may be forfeited and an alternate potential winner may, at Sponsor's discretion, be selected.

CONDITIONS


Contest is subject to these Official Rules. By participating, Contestant agrees: (i) to be bound by these complete Official Rules and the decisions of Sponsor which shall be final and binding; and (ii) to waive any right to claim ambiguity in the Contest or these Official Rules, except where prohibited by law. Sponsor reserves the right to cancel or suspend the Contest, in its sole discretion, should it receive fewer than 20 entries, or receive no entries that have a judged score above 70 points, or due to circumstances beyond its control, including natural disasters. Sponsor may, in its sole discretion, cancel, modify or suspend the Contest should a virus, bug, computer problem, unauthorized intervention or other causes beyond Sponsor's control, corrupt the administration, security or proper play of the Contest. Sponsor may prohibit a Contestant from participating in the Contest or winning a prize if, in its sole discretion, it determines such entrant is attempting to undermine the legitimate operation of the Contest by cheating, deception, or any other unfair playing practices of intending to annoy, abuse, threaten, undermine or harass any other players or Sponsor representatives. Disputes regarding these Official Rules and/or this Contest will be governed by the internal laws of the State of North Carolina.

By participating in the Contest, Contestant agrees that under no circumstances, including, but not limited to, negligence, shall Sponsor or its licensors, its and their respective officers, directors, employees, shareholders, agents, successors, and assigns, and all prize providers (the "Released Parties") be liable for any direct, indirect, incidental, special, or consequential damages arising out participation in the Contest, even if any or all of the Released Parties have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, therefore such exclusions may not apply to you. Sponsor, Sponsor's parent companies, affiliates, subsidiaries, licensors, advertising, promotion, and fulfillment agencies, and legal advisors, and prize providers, and the respective employees, officers, directors, shareholders, agents, and representatives of each, are not responsible for and shall not be liable for: (i) any errors in Contest-related materials, or late, lost, delayed, damaged, misdirected, stolen, incomplete, illegible, or unintelligible, notices, releases, forms, affidavits, or other correspondence; (ii) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, interruptions or difficulties of any kind; (iii) failed, incomplete, garbled, or delayed computer transmissions; (iv) any condition caused by events beyond the control of the Sponsor that may cause the Contest to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind arising in connection with or as a result of the prizes, or acceptance, possession, or use of the prizes, or from participation in the Contest or arising from the entrant's access to and use of the Internet site www.makesomethingunreal.com (and all related websites of Sponsors, including www.epicgames.com), including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy, to the extent permitted by law; or (vi) any errors in any materials associated with the Contest. Sponsor reserves the right to cancel, suspend and/or modify the Contest if any problem corrupts the administration, security, or operation of the Contest, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any Contestant it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

PRIVACY


All personal information collected by Sponsor will be used for the administration of the Contest and in conjunction with these Official Rules. Please refer to Sponsors privacy policy located at www.makesomethingunreal.com/tos.aspx for important information regarding the collection, use and disclosure of personal information by Sponsors.

DISPUTES


Contest is governed by the laws of the United States and the State of North Carolina. As a condition of participating in the Contest, entrant agrees that any and all actions or proceedings related to the Contest shall be exclusively brought in Wake County, State of North Carolina (if under state law) or the U.S. District Court for the Eastern District of North Carolina (if under Federal law), and the parties agree not to raise in connection therewith, and hereby waive, any defenses based upon the venue, the inconvenience of the forum, the lack of personal jurisdiction, the sufficiency of service of process or the like in any such action or suit brought in the State of North Carolina.

WINNERS LIST AND OFFICIAL RULES


A winners list will be posted on the web site www.makesomethingunreal.com until 90 days after the end of Contest. To obtain a copy of the winners list or a copy of these Official Rules, send your request along with a stamped, self-addressed envelope to: Epic Games.
